Terms and Conditions of Use
Please read these Terms and Conditions (“Agreement”) carefully before using the field and its facilities. By signing below, you agree to be bound by all provisions of this Agreement.
- Assumption of Risk & Liability Waiver
1.1. Inherent Risk. I acknowledge that horse riding and associated activities involve inherent risks, including serious injury or death. I voluntarily assume all such risks.
1.2. “As-Is” Facilities. I understand that the field and all equipment (e.g. cross-country jumps, show jumps, obstacles) are provided “as-is.” I am responsible for inspecting the field and equipment before each use to ensure safety and suitability.
1.3. Liability Waiver. I waive and release any and all claims, demands, or causes of action against Charlotte ([07817 879190]), Dene Williams ([07737 085003]), and [Field Owner/Company Name], including their owners, employees, agents, and affiliates (collectively, “Released Parties”), for injury, death, loss, or damage arising out of my use of the field, whether caused by negligence or otherwise.
- Safety Rules
2.1. Buddy System. I will not use the field alone; a competent person must be present at all times.
2.2. Protective Gear. I will wear a certified riding helmet and body protector at all times while mounted. Additional safety gear (e.g. gloves, boots, hi-vis) is strongly encouraged.
2.3. Pre-Use Inspection. Before each session, I will conduct a thorough safety inspection of the field, jumps, and all equipment. I will refrain from using any item or area that appears unsafe.
2.4. Damage Reporting. I will immediately report any damage, defect, or unsafe condition to Charlotte or Dene Williams. Contact numbers: as above.
2.5. Equipment Return. After use, I will neatly return all showjumping poles, standards, and accessories to their designated storage and ensure they are left in good order.
- Field Conduct & Etiquette
3.1. Consideration. I will share the field respectfully with other users, maintaining safe distances and communication.
3.2. Dogs & Animals. Well-behaved dogs are permitted but must be kept under control on a short lead. Any animal posing a safety risk must be removed immediately.
3.3. No Unauthorized Alterations. I will not modify, move, or add jumps or obstacles without prior written approval.
- Booking, Payment & Cancellation
4.1. Booking Confirmation. Use of the field is by advance booking only. Reservations are confirmed upon receipt of payment.
4.2. Payment Terms. Fees are payable in full at the time of booking, unless otherwise agreed in writing.
4.3. Cancellation Policy. Cancellations made more than 48 hours before the booking will receive a full refund. Cancellations within 48 hours are non-refundable, unless the field is rebooked.
- Insurance & Medical Emergencies
5.1. Insurance. I confirm that I hold valid, current riding insurance covering third-party liability and personal injury.
5.2. First Aid. I will carry a personal first-aid kit and mobile phone. In the event of serious injury, I will call emergency services (999) first, then notify Charlotte or Dene Williams.
- Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, losses, liabilities, damages, and costs (including legal fees) arising from my use of the field, including claims by third parties.
- Compliance with Laws & Regulations
I will comply with all applicable laws, regulations, local bylaws, and any posted rules. Non-compliance may result in immediate termination of field use without refund and potential legal action.
- Privacy & Data Protection
Any personal information you provide (e.g., contact details, medical conditions) will be held and processed in accordance with the Data Protection Act 2018 and GDPR. It will be used solely to manage bookings, ensure safety, and comply with legal obligations.
- Amendment & Severability
9.1. Amendments. We reserve the right to amend these Terms at any time. Notice of any change will be provided by email or posted on site. Continued use of the field constitutes acceptance of the revised Terms.
9.2. Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Governing Law
This Agreement is governed by and construed in accordance with the laws of England and Wales. Any dispute arising under this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
